General Terms and Conditions – Public Trips
of Hohentwiel Schifffahrtsgesellschaft m.b.H.

1. Area of Application
These General Terms and Conditions apply to the legal relationships between Hohentwiel Schifffahrtsgesellschaft m.b.H. and its patrons. They are part of the agreement entered into by the purchase of tickets.

2. Boarding/Opening Hours
If not stated otherwise, boarding starts 15 minutes before departure. Slight delays are possible due to port traffic.
Office hours during the season (May - September):
Monday - Friday 08:00 a.m. - 05:00 p.m., Saturday 09:00 a.m. - 12:00 p.m.
Off-season office hours: Monday - Friday 08:00 a.m. - 07:00 p.m.

3. Entrance Fees
Hohentwiel trips are tax-free. For trips with catering or similar included in the price, the tax is stated on the invoice. The tax rate depends on the port of departure.

- Children (5 - 15 years)
Admission is free for children younger than 5. These children must be declared at the time of booking. The discount for children aged 5 - 15 years is approximately 50 %.

- Groups (20 or more)
For group bookings of more than 20 persons, we offer a 5 % discount on the actual trip portion of the overall price. Since, due to the length of the trip, the trip portion of the price is practically the same for all options, we offer a fixed discount of € 1.80 for adults, and € 0.90 for children aged 5 - 15 to keep things simple. The discount does not apply to catering services. When a lounge is booked exclusively for a group not requiring all of the available seats, the unused seats are charged at the trip portion of the overall price.

We do not offer discounts for seniors, handicapped persons, or regulars.

4. Tickets
Tickets can be purchased in writing, by phone, online, at our office in Hard, or at a number of ticket agencies. The number of available tickets depends on the type of trip. For certain trips, additional tickets can be purchased directly on board (weather permitting). Availability cannot be guaranteed; booking these tickets in advance is not possible. The decision whether or not to offer additional tickets is made by the skipper on the day of the trip in question.
By purchasing a ticket, the patron agrees to the house rules of Hohentwiel Schifffahrtsgesellschaft m.b.H. In case of non-compliance, the persons in question can be expelled from the ship. Tickets are only valid for the booked trip as specified on the boarding pass.
Any unauthorized duplication and/or distribution of counterfeit tickets will be prosecuted, and the patron can be held liable for any subsequent damage.

5. Seat Reservations
It is not possible to reserve seats for round trips or trips not including catering. The patrons have free choice of seats.
Catered trips have assigned seating. Seating requests can be made at the time of booking. Hohentwiel Schifffahrtsgesellschaft m.b.H. will try to consider your preferences if possible, but choice of seats cannot always be guaranteed.

6. Catering
Hohentwiel Gastronomiegesellschaft m.b.H. is responsible for on-board catering services. On round trips, the passengers can order from a small menu, or from a cake and strudel buffet. On catered trips, a set meal is served. There are no à-la-carte options.
Due to the limited facilities on board, it is not possible to prepare alternative meals at short notice. Our kitchen staff will consider any requests concerning food intolerances, allergies, vegetarian options etc. that are made at the office of Hohentwiel Schifffahrtsgesellschaft m.b.H. at the latest three days before the trip. Later requests, especially when made only on the day of or during the trip, cannot be considered.

7. Gift Certificates
Gift certificates are available for all trips. These are available only at Hohentwiel Schifffahrtsgesellschaft m.b.H. Gift certificates do not come with a fixed date, so that the persons receiving such a gift can pick the date themselves. Gift certificates are valid for three years; they expire on the date stated on the certificate. The trip for which the gift certificate is to be used must be booked in advance. The value of the GIFT certificate at the date of issue is subtracted from the price of the trip. When redeeming a gift certificate, any price difference due to tariff changes must be paid.
Only gift certificates that have been paid for are valid. Gift certificates are redeemable only for trips with Hohentwiel Schifffahrtsgesellschaft m.b.H. They can be redeemed by phone, or by entering the certificate number in the booking form on the website of Hohentwiel Schifffahrtsgesellschaft m.b.H. The certificate must be filled out with the booking confirmation data. With this information, the certificate is a valid ticket and must be presented when boarding the ship. Certificates without confirmation data are invalid and will not be accepted as a ticket. Any remaining balance of less than € 20.00 will be paid out in cash when boarding. For balances higher than € 20.00, the patron will receive a voucher that can be redeemed for a trip with Hohentwiel Schifffahrtsgesellschaft m.b.H. within three years.
These vouchers cannot be refunded or exchanged for cash.

8. Online Booking
Tickets booked online can be paid by credit card (PayPal) or by invoice.
Online tickets can only be printed at home when paying by credit card; they are only valid with a barcode and printed in DIN A4 format. Tickets presented on mobile phones or other devices are not valid and cannot be accepted. Gift certificates cannot be printed at home.

9. Exchanging/Returning Tickets
Booked tickets can be cancelled up to three days before the date of the trip. Tickets can be rebooked for a different date as long as seats are available; otherwise the patron receives a voucher to the value of the cancelled tickets. Later cancellations are not possible. If the patron misses the booked trip without prior cancellation, the ticket will also become invalid. Tickets cannot be returned for cash.
Tickets for the Bregenz Festival cannot be cancelled.

10. Lost Tickets or Gift Certificates
When a ticket is lost, the patron is not entitled to the booked trip or a refund. It is possible to issue a one-time replacement ticket. To issue a replacement ticket, we need the date of the trip and the name of the person who booked it.
Lost gift certificates/vouchers cannot be redeemed or reissued. Patrons are responsible for their gift certificates/vouchers not becoming available to any third parties. It is not possible for Hohentwiel Schifffahrtsgesellschaft m.b.H. to retrace gift certificates/vouchers to verify if they are redeemed by their rightful owners. Thus, Hohentwiel Schifffahrtsgesellschaft m.b.H. is not liable to pay compensation for such losses and/or damage.

11. Payment
Tickets and gift certificates for public trips can be paid online on our website by credit card (PayPal) or by invoice. When paying by credit card, the tickets can be printed directly from the PC, or mailed upon receipt of payment. When paying by invoice, the tickets or gift certificates are sent by mail, invoice included. The invoice is payable 14 days after the billing date. If the invoice is not paid by the due date, a reminder will be sent to the billing address. After the third reminder, we will refer the matter to an attorney.
When booking at the office of Hohentwiel Schifffahrtsgesellschaft m.b.H., the payment options are cash or invoice only.
On board the Hohentwiel, only cash payment is possible.

12. Mailing Fees
For mailing tickets or gift certificates, we charge a flat-rate mailing fee of € 1.50 per postal item. For orders totalling € 250.00 or more per postal item, and for tickets printed at home, no fee is charged.

13. Cancellation of Trips
When a trip is cancelled due to force majeure, such as storms, floods, damage to the ship or the engine, Hohentwiel Schifffahrtsgesellschaft m.b.H. does not assume any liability for consequential expenses of the patrons', such as overnight stays at hotels, travelling expenses or similar. Any payments made to Hohentwiel Schifffahrtsgesellschaft m.b.H. will be reimbursed in full.
Hohentwiel Schifffahrtsgesellschaft m.b.H. reserves the right to cancel trips that are booked to less than 25 % of their capacity two weeks before the date of the trip. In such a case, the patrons have the option to rebook for another date, as long as there are seats available; or to receive a voucher to the value of the cancelled tickets. Patrons who do not wish to take up one of these options can also opt for a refund.

14. Miscellaneous
Bicycles are not allowed on board.

Buggies and baby carriages can be taken on board and parked at the entrance.
Wheelchairs can be taken on board, but due to its age and authentic restoration, the historical ship is not entirely handicapped-accessible.

Animals are not allowed on board.

If not stated otherwise, there is no dress code. Shoe heels must be at least 2 x 2 cm.

The lounges are strictly non-smoking; smoking is permitted only on the upper deck.

Dancing is not possible on board the Hohentwiel.

15. Lost Items
Hohentwiel Schifffahrtsgesellschaft m.b.H. is not responsible for items lost or left on board. Items found on board can be turned in to the staff or at the office of Hohentwiel Schifffahrtsgesellschaft m.b.H.
For lost personal items, check with the office. When the items are found, they can be claimed at the office or, depending on the item, sent to you for a service fee.

16. Exclusion of Liability
Parents are responsible for supervising their children. Hohentwiel Schifffahrtsgesellschaft m.b.H. does not assume any supervisory duties for children on board.
Hohentwiel Schifffahrtsgesellschaft m.b.H. accepts no responsibility for personal belongings left unattended, e.g. pieces of clothing, shoes, umbrellas, or baby carriages. For reasons of safety, umbrellas cannot be taken into the passenger area and must be checked with the staff. If you want to secure a valuable item for special safekeeping please ask a staff member. However, please note that we cannot accept any responsibility for such items.

17. Data Privacy Statement
Personal data given for the initial booking, as well as changes to these personal data, will be recorded and used for the transaction. The transaction includes in particular the reservation, booking and payment, and, if applicable, the mailing of all documents to the address given. The patrons agree to their personal information being stored electronically for payment purposes, and used for internal purposes such as marketing activities or the distribution of new timetables at the beginning of the year. Personal data collected by us will not be made available to any third parties. Credit card data will not be stored.

The website of Hohentwiel Schifffahrtsgesellschaft m.b.H., uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer to help the website analyse how visitors use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the USA. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. You may refuse the use of cookies by selecting the appropriate settings on your browser; however please note that if you do this you may not be able to use all functions of this website to their full extent. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
We use PayPal for credit card payments. For such transactions, the data protection provisions of PayPal apply.

18. Right to Deny Access
We reserve the right to deny access to patrons if we have reason to assume that they might disturb the trip or harass other passengers. Access can also be denied to patrons who have previously failed to comply with our terms and conditions.

Safety instructions can be viewed on board.
The ship is classified as complying 100 % with the construction and equipment provisions of the Germanische Lloyd.

19. Charter Trips
These Terms and Conditions only apply to trips that are open to the public, not to private charter trips. The Terms and Conditions for charter trips are available on our website, menu item "Fahrten/AGB", or at the office of Hohentwiel Schifffahrtsgesellschaft m.b.H.

20. Applicable Law/Place of Jurisdiction
Austrian law applies. The agreed place of jurisdiction is the court responsible in local and subject matter for A-6971 Hard.

An impressive ship with a lot of style and lovingly restored. A great atmosphere to cruise on a paddle steamer towards the sunset. The crew, the captain, crew and the ship’s cook all delighted us in equal measure.
