General Terms and Conditions – Charter Trips
of Hohentwiel Schifffahrtsgesellschaft m.b.H.

1. Area of Application
These General Terms and Conditions apply to the legal relationships between Hohentwiel Schifffahrtsgesellschaft m.b.H. and its patrons. They are part of the booking contract for the entire ship.

2. Boarding/Opening Hours
If not agreed otherwise, boarding starts 15 minutes before departure. Slight delays are possible due to port traffic.
Office hours during the season (May - September):
Monday - Friday 08:00 a.m. - 05:00 p.m., Saturday 09:00 a.m. - 12:00 p.m.
Off-season office hours: Monday - Friday 08:00 a.m. - 07:00 p.m.

3. Patron
The person signing the contract is considered the patron. Signing in lieu of a third party is not possible. All liability lies with the patron.

4. Charter Prices
The charter price is calculated based on the actual length of the trip and services booked. A flat-rate priced is charged for groups of up to 135 persons. A fixed additional price is charged for every additional person.

5. Catering
a) Number of Persons
Hohentwiel Schifffahrtsgesellschaft m.b.H. can only accommodate as many persons as there are seats available below deck. Weather permitting, events take place on the upper deck, and below deck in bad weather conditions as arranged with the patron. Special arrangements are possible depending on the individual event.
In order for Hohentwiel Schifffahrtsgesellschaft m.b.H. to be able to guarantee a smooth and trouble-free event, the patron must keep to the number of persons stated in the contract. If the number of persons is increased without written confirmation, Hohentwiel Schifffahrtsgesellschaft m.b.H. cannot guarantee to have sufficient food and beverages available. The definite number of persons must be given to Hohentwiel Schifffahrtsgesellschaft m.b.H. at the latest three days before the trip.
Due to the limited facilities on board, it is not possible to prepare alternative meals at short notice. Our kitchen staff will consider any requests concerning food intolerances, allergies, vegetarian options etc. that are made at the office of Hohentwiel Schifffahrtsgesellschaft m.b.H. at the latest three days before the trip. Later requests, especially when made only on the day of or during the trip, cannot be considered.

b) Capacity
Depending on the number of persons, there are several options for catering:

Buffet/flying buffet : max. 85 persons
Set meal: max. 110 persons
Apéro/hors d'oeuvres: max. 135 persons

Any other arrangements must be arranged in writing with Hohentwiel Schifffahrtsgesellschaft m.b.H.

c) Billing for Food and Beverages
Beverages are charged as consumed. The full price is charged for every opened bottle. All booked meals are charged in full, even if the event was attended by fewer persons than booked.

d) External/Third Party Caterers
Food or beverages provided by an external caterer are not allowed on board. Any exceptions must be arranged with Hohentwiel Schifffahrtsgesellschaft m.b.H. and confirmed in writing. In such a case, we charge a flat-rate service fee.

6. Cancellation by the Patron
If the trip is cancelled by the patron, the following cancellation fees apply:

cancellation more than 6 months before date of trip: free of charge
cancellation up to 6 months before date of trip: 20 % of set charter price
cancellation up to 5 months before date of trip: 30 % of set charter price
cancellation up to 4 months before date of trip: 40 % of set charter price
cancellation up to 3 months before date of trip: 50 % of set charter price
cancellation up to 2 months before date of trip: 75 % of set charter price
cancellation up to 1 month before date of trip: 100 % of set charter price

7. Music
Bands or any other type of musical entertainment must be registered by the patron directly with AKM Österreich. The patron bears all incurring costs.

8. Payment
If not agreed otherwise, the invoice is issued after the trip. The decisive factor for the invoice total is the captain's or skipper's statement on charter time, number of persons, empty trip, and idle time after the trip.
Payment is to be made by bank transfer to one of the three accounts of Hohentwiel Schifffahrtsgesellschaft m.b.H. (depending on the country in question), exempt from charges. The invoice is payable 14 days after the billing date. If the invoice is not paid by the due date, a reminder will be sent to the billing address. After the third reminder, we will refer the matter to an attorney.

9. Cancellation of Trips
When a trip is cancelled due to force majeure, such as storms, floods, damage to the ship or the engine, Hohentwiel Schifffahrtsgesellschaft m.b.H. does not assume any liability for consequential expenses of the patrons', such as overnight stays at hotels, traveling expenses or similar. Any payments made to Hohentwiel Schifffahrtsgesellschaft m.b.H. will be reimbursed in full.
Hohentwiel Schifffahrtsgesellschaft m.b.H. reserves the right to refuse bookings or to cancel booked trips on short notice if the character of the event might have a negative effect on the image of the Hohentwiel.

10. Miscellaneous
Bicycles are not allowed on board.
Buggies and baby carriages can be taken on board and parked at the entrance.
.Wheelchairs can be taken on board, but due to its age and authentic restoration, the historical ship is not entirely handicapped-accessible.

Animals are not allowed on board.

If not stated otherwise, there is no dress code. Shoe heels must be at least 2 x 2 cm.

The lounges are strictly non-smoking; smoking is permitted only on the upper deck.

Dancing is not possible on board the Hohentwiel.

11. Lost Items
Hohentwiel Schifffahrtsgesellschaft m.b.H. is not responsible for items lost or left on board. Items found on board can be turned in to the staff or at the office of Hohentwiel Schifffahrtsgesellschaft m.b.H.
For lost personal items, check with the office. When the items are found, they can be claimed at the office or, depending on the item, sent to you for a service fee.

12. Exclusion of Liability
Parents are responsible for supervising their children. Hohentwiel Schifffahrtsgesellschaft m.b.H. does not assume any supervisory duties for children on board.
Hohentwiel Schifffahrtsgesellschaft m.b.H. accepts no responsibility for personal belongings left unattended. This includes items such as pieces of clothing, shoes, umbrellas, or baby carriages etc. For reasons of safety, umbrellas cannot be taken into the passenger area and must be checked with the staff. If you want to secure a valuable item for special safekeeping, please ask a staff member. However, please note that we cannot accept any responsibility for such items. The patron is liable for any damage to the ship, equipment, or buildings caused by him or his guests.

13. Data Privacy Statement
Personal data given for the initial booking, as well as changes to these personal data, will be recorded and used for the transaction. The transaction includes in particular the reservation, booking and payment, and, if applicable, the mailing of all documents to the address given. The patrons agree to their personal information being stored electronically for payment purposes, and used for internal purposes such as marketing activities or the distribution of new timetables at the beginning of the year. Personal data collected by us will not be made available to any third parties. Credit card data will not be stored.

The website of Hohentwiel Schifffahrtsgesellschaft m.b.H., uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer to help the website analyse how visitors use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the USA. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. You may refuse the use of cookies by selecting the appropriate settings on your browser; however please note that if you do this you may not be able to use all functions of this website to their full extent. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above. We use PayPal for credit card payments. For such transactions, the data protection provisions of PayPal apply.

14. Right to Deny Access
We reserve the right to deny access to patrons if we have reason to assume that they might disturb the trip or harass other passengers. Access can also be denied to patrons who have previously failed to comply with our terms and conditions.

Safety instructions can be viewed on board.
The ship is classified as complying 100 % with the construction and equipment provisions of the Germanische Lloyd.

15. Public Trips
These Terms and Conditions only apply to charter trips, not to trips that are open to the public. The Terms and Conditions for public trips are available on our website, menu item "Fahrten/AGB", or at the office of Hohentwiel Schifffahrtsgesellschaft m.b.H.

16. Applicable Law/Place of Jurisdiction
Austrian law applies. The agreed place of jurisdiction is the court responsible in local and subject matter for A-6971 Hard.

Everything turned out splendid – the weather, the crew, the service, the food and the guests. It was great watching the landscape slowly slide past the ship. Truly something special for everyone in many ways.
